Medicaid changes

How will the new federal Medicaid law (OBBBA) affect home care in [state]?

It depends on your state. Some changes begin between October 2026 and early 2027, and states choose how and when to carry them out. Expansion states face work rules and six-month renewals first. Check your state Medicaid agency’s OBBBA page for dates, and for how your waivers are affected.

The federal law (OBBBA, signed July 2025) leaves a lot to states, so two states can look very different.

Items with dates:

  1. October 1, 2026: narrower federal definition of qualified immigrant for Medicaid.
  2. December 31, 2026: work (community engagement) rules and six-month renewals for expansion adults. States can ask for a delay. CMS’s June 2026 interim final rule says states generally start by January 1, 2027.
  3. January 1, 2027: shorter retroactive coverage.
  4. 2028: state-directed payment step-downs, a home equity limit for long-term care, and a new stand-alone HCBS waiver option on July 1.

How to find your state’s answer:

  1. Check whether your state expanded Medicaid. Many of the work rules target expansion adults.
  2. Look on your state Medicaid site for "H.R. 1" or "OBBBA" notices.
  3. Read your waiver provider alerts and emails.
  4. Ask your state home care association for updates.

Example: Georgia did not expand Medicaid. Georgia Pathways, its limited coverage program, changes on January 1, 2027.

Confirm with your state agency. Rules and dates keep moving.
