Does the Medicaid work requirement apply to my clients in Georgia?
Most home care clients are not the target. The federal rule covers adults 19 to 64 in the Medicaid expansion group or certain waivers, and it exempts medically frail and disabled people. Georgia has not expanded Medicaid. Georgia Pathways already has a work rule, and it changes on January 1, 2027.
Short version: probably not for your typical waiver client, but check.
What the federal rule says (CMS interim final rule, June 2026):
- It applies to non-pregnant adults 19 to 64 who are not on Medicare and who are in the Medicaid adult group or certain 1115 demonstrations.
- The requirement is 80 hours a month of work, community service, a work program, or half-time school, or income of at least $580 a month in 2026.
- States generally start by January 1, 2027.
- Medically frail people, disabled people, and many caregivers of a dependent child are exempt.
Georgia:
- Georgia has not expanded Medicaid, so the main OBBBA work rule is aimed at other states.
- Georgia Pathways is a limited coverage program with its own 80-hour rule. It is not a home care waiver.
- Georgia’s Pathways page says H.R. 1 changes take effect January 1, 2027, and current members are not affected until their 2027 renewal.
Clients on CCSP, SOURCE, ICWP, NOW, COMP or GAPP qualify because of age, disability or medical needs. Their coverage rules differ.
If a client says they got a work-rule notice, ask them to call the number on the letter. We cannot tell you what applies to one person.
