Do I have to use E-Verify as a home care agency in Georgia?

Georgia law has required private employers with more than ten employees to use E-Verify for new hires since July 2013. Agencies show proof when they renew their business license. A 2013 law firm alert is my source, so check current rules with Georgia Department of Labor or your city.

The Georgia law sometimes called the "11 or more" rule requires private employers in Georgia with more than ten full-time employees to use the federal E-Verify system for new hires. A law firm alert from 2013 says it took effect July 1, 2013.

Its main points:

  1. Count employees who work 35 or more hours a week, as of January 1 each year.
  2. Enroll in E-Verify, or use an agent.
  3. Use it for new hires and rehires only, after an offer has been made and accepted.
  4. Post notices in English and Spanish.
  5. Do not take action against a worker during a tentative nonconfirmation period.
  6. Show proof of E-Verify use when you apply for or renew your business license or occupational tax certificate. Small employers can show they are exempt.

The source is more than ten years old, so counts and procedures may have changed. E-Verify use is also separate from the I-9 form, which you must complete for everyone.

Check current rules with the Georgia Department of Labor, your city or county license office, and your attorney.
