New York EVV and Medicaid home care, in plain words.
In New York most home care money flows through Managed Long Term Care health plans, so your contracts with plans matter as much as your Medicaid number. You need a LHCSA license from the Department of Health.

New York at a glance
EVV, Medicaid and billing in New York.
Dates that matter: Personal care EVV required from 1 Jan 2021; home health from 1 Jan 2023. A November 2024 State Comptroller audit found no claim edit was turned on and no claims had been denied for missing EVV; DOH said it was drafting rules to pend then deny unmatched claims. No enforcement date published as of this research.
Licensing: Licensed Home Care Services Agency (LHCSA) license from NYSDOH (Public Health Law Article 36), with a public-need / Certificate of Need style review.
Managed care: Yes. Most adults needing more than 120 days of community long-term care must enroll in an MLTC plan (Partial Capitation, MAP or PACE). Agencies contract with and bill each plan. A smaller group stays fee-for-service through eMedNY.

Same rules, same tangle
In New York, the visit still gets typed four more times.
The caregiver taps in. The visit goes to your state’s EVV system. Then someone in your office carries it by hand into payroll, into billing, into the chart, and to the family on the phone. Every carry is a chance for the numbers to drift. When they do, New York denies the claim, and you find out weeks later. That is Tangleware™: good tools, and an owner in the middle.

What New York owners ask.
Does New York give me a free EVV app?
No. New York uses a Choice Model. You choose and pay for your own EVV system, and it must send each visit to the state’s EVV Data Aggregator. Health plans you contract with may add their own rules, so read each plan agreement before you choose.
Will my claims be denied if EVV is missing?
As of the State Comptroller’s November 2024 audit, the eMedNY edit that would block payment was not turned on, and no claims had been denied for missing EVV. The Department of Health said it was writing rules to pend and then deny unmatched claims. Treat missing EVV as a future denial and a current audit risk.
Why do MLTC plan contracts matter so much?
Most adults who need long-term home care must join a Managed Long Term Care plan. The plan approves hours and pays you. A Medicaid number alone brings little work in New York; contracts with the plans active in your counties bring referrals and payment.
What license do I need to provide personal care?
A Licensed Home Care Services Agency (LHCSA) license from the New York State Department of Health. The review looks at need in the counties you want to serve, your finances, and the owners’ background. Plan for a long review and check current rules for adding counties before you apply.
